Student Loan Borrowers Sue the Department of Education

Student loan borrowers have  against the Department of Education, asserting that the Trump Administration must restart the SAVE plan. The SAVE plan, created under the Biden Administration, is an income-driven repayment program designed to help borrowers access lower monthly payments and achieve faster loan forgiveness. 

The SAVE plan has faced significant challenges. For over a year, the program was blocked due to Republican-led state legal challenges. However, in February, a federal district court dismissed a key lawsuit prompting borrower advocates to call for the program’s immediate reinstatement. 

As of Monday, March 9, the Trump Administration has not restarted the program, leaving current enrollees stuck in forbearance. The lawsuit aims to compel the Administration to resume the SAVE plan. Even if reinstated, the plan is scheduled to phase out in July 2028 under the .
